Binding Agreement

• “User”, “you”, “your”: Refers to any individual or entity accessing or using the Site or Services, whether as a visitor, subscriber, registered account holder, or contributor of content.
• “Account”: Refers to the unique user account created by an individual or entity to access and use the Site and Services.
• “Subscription”: Refers to any of the various subscription-based plans offered by Traders Money LLC, which provide different levels of access to the Services based on the chosen plan.
• “Evaluation Account”: Refers to a simulated trading account provided to Users as part of the platform’s services to evaluate trading performance before accessing funded accounts.
• “Funded Account”: Refers to a trading account provided by the Company after successful completion of an evaluation phase, which allows the User to trade with real capital provided by the Company or its partners.
• “Content”: Refers to all information, data, software, text, displays, images, video, audio, and any other material made available by Traders Money LLC through the Site or Services, including proprietary and third-party content.
• “Intellectual Property”: Refers to any intellectual property owned by Traders Money LLC, including but not limited to trademarks, copyrights, logos, trade names, designs, software, and any proprietary technology or content related to the Site or Services.
• “Terms”: Refers to these Terms and Conditions, as well as any other applicable policies, rules, or agreements referenced herein, governing the use of the Site and Services.
• “Third-Party Services”: Refers to services, content, or products provided by third parties that are accessible via links or integrations on the Site or through the Services.

3. Use of Services

3.1 Permitted Use

By accessing and using the Traders.Money Site and Services, you agree to use them solely for lawful purposes and in accordance with these Terms. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Services for personal, non-commercial purposes. You agree that you will not:

• Use the Services to exploit or harm others, including but not limited to any attempts to manipulate or unfairly influence the trading environment or use the platform for fraudulent or illegal activities.
• Access or attempt to access any portion of the Site or Services by any means other than the interface provided by Traders.Money.

3.2 Conditions for Access

Access to certain parts of the Site and Services may require you to register and create an account. You must ensure that all information provided during the registration process is accurate, complete, and current. You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account.

Traders.Money reserves the right to refuse service, suspend accounts, or terminate access to any part of the Services at its sole discretion, without prior notice or liability, if it suspects that a violation of these Terms has occurred.

3.3 Prohibited Activities

While using the Services, you agree that you will not:

• Share your login credentials with others or allow any third party to access the Site or Services using your account. Violating this policy may result in the immediate suspension or termination of your account.
• Share proprietary information, such as trading strategies, analysis tools, or market signals, with anyone who is not authorized to access them.
• Reverse-engineer, copy, reproduce, or distribute any part of the Services, software, or content without the express written consent of Traders.Money.
• Use any automated means, including scraping, bots, or spiders, to access or manipulate data or Services provided by Traders.Money.

3.4 Legal Compliance

By using the Services, you agree to comply with all applicable laws and regulations, including financial market regulations, securities trading laws, and international compliance standards. Any activity that Traders.Money deems suspicious or in violation of financial regulations will result in the immediate termination of your account and may lead to legal action.

4. User Eligibility and Representations

4.1 Eligibility to Use Services

By accessing or using the Traders.Money Site or Services, you represent and warrant that:

• You are at least the age of majority in your jurisdiction (18 years old or older, or the legal age in your jurisdiction).
• You have full legal capacity to enter into a binding agreement, and there are no legal or contractual restrictions preventing you from agreeing to these Terms.
• You are not barred from using the Site or Services under any applicable law or regulation.

If you are using the Services on behalf of a business entity or any third party, you further represent that you have the authority to bind such entity to these Terms. In such cases, “you” will refer to both the individual user and the applicable entity.

4.2 User Representations

By using the Services, you represent and warrant that:

• All information provided by you to Traders.Money during account registration and at all other times will be true, accurate, current, and complete.
• You will promptly update any information necessary to ensure it remains true, accurate, and complete.
• You will use the Services only for lawful purposes and in compliance with all applicable laws and regulations.
• You are not currently restricted from using the Services due to any prior violations of these Terms, applicable laws, or prior involvement in fraudulent or illegal activities.

4.3 Compliance with Local Laws

You acknowledge and agree that you are solely responsible for ensuring that your use of the Site and Services complies with all applicable local, state, national, and international laws, regulations, and rules. This includes but is not limited to financial, tax, and data protection laws.

If your use of the Services is found to be in violation of any law or regulation, Traders.Money reserves the right to terminate your account immediately and take any necessary legal action.

4.4 Prohibition for Minors

If you are under the age of majority in your jurisdiction, you are prohibited from using the Services. Traders.Money does not knowingly collect or solicit personal information from individuals under the age of majority. If we become aware that a user under the age of majority has registered on the Site, we will promptly delete their account and any associated data.

4.5 Business Entity Use

If you are using the Services on behalf of a business entity, you represent and warrant that the business entity will be responsible for compliance with these Terms. The business entity will also be responsible for ensuring that all individual users within the entity comply with these Terms.

5. Account Creation and Single-Account Policy

5.1 Account Registration

To access certain features and Services on Traders.Money, you must register and create a personal account. You agree to provide accurate, complete, and up-to-date information during the registration process. You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password, and for any activities or actions that occur under your account.

Traders.Money reserves the right to refuse service, terminate accounts, or revoke access to the platform if it is determined that you have violated these Terms or provided false information during registration.

5.2 Single-Account Policy

Users are permitted to create and maintain only one account on Traders.Money. The use of multiple accounts by the same individual is strictly prohibited unless explicitly authorized in writing by Traders.Money. Any attempt to create multiple accounts to bypass account limits, receive multiple benefits, or for any other reason will result in the suspension or termination of all associated accounts.

5.3 Account Non-Transferability

Your Traders.Money account is personal to you and is non-transferable. You are not permitted to sell, transfer, or assign your account or any rights related to the Services to any other individual or entity. Sharing your account credentials with others is strictly prohibited and may result in account suspension, termination, and possible legal action.

5.4 Prohibited Sharing of Credentials

You are expressly prohibited from sharing your login credentials with any third party. Allowing another individual or entity to access your account, even temporarily, is a violation of these Terms and may result in the immediate suspension or termination of your account. Traders.Money takes account security seriously and reserves the right to investigate and act on any unauthorized use of accounts.

5.5 Account Security and Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Immediately notify Traders.Money of any unauthorized access or use of your account.
• Take reasonable steps to prevent unauthorized access by protecting your login credentials.
• Ensure that you log out from your account at the end of each session, especially when accessing the platform from shared or public devices.

Traders.Money will not be liable for any loss or damage arising from your failure to comply with these security obligations.

5.6 Account Termination

Traders.Money reserves the right to suspend, restrict, or terminate your account at its sole discretion, with or without prior notice, if it suspects that your account has been compromised, is being misused, or if you are found in violation of these Terms. Upon termination, any outstanding obligations or rights you may have accrued (such as unpaid fees) will still be enforceable.

6. Prohibited Conduct

6.1 Sharing of Login Credentials

You are strictly prohibited from sharing your account login credentials (username and password) with any third party. Your account is intended for your personal use only, and allowing another individual or entity to access your account constitutes a violation of these Terms. Any detected account sharing may result in the immediate suspension or termination of your account without prior notice, at the sole discretion of Traders.Money.

6.2 Unauthorized Access and Use

You agree not to attempt to access any restricted parts of the Site or Services that you are not authorized to access. This includes bypassing or attempting to bypass any security measures or access controls implemented by Traders.Money. Any unauthorized access to the platform, including the use of another user’s account credentials or attempting to manipulate the system, will result in immediate termination of your account and potential legal action.

6.3 Prohibition on Sharing Proprietary Information

Users are prohibited from sharing or distributing proprietary information, such as trading strategies, analysis tools, signals, or any other content made available through the Services, to any person or entity outside the platform. Such information is provided exclusively for the personal use of the registered account holder. Any unauthorized distribution or commercial use of Traders.Money’s proprietary content is a violation of copyright law and these Terms and may result in legal action.

6.4 Prohibited Trading Practices

While using Traders.Money’s trading tools or evaluation accounts, you agree not to engage in any prohibited or unethical trading practices, including but not limited to:

• Exploiting errors in the system or pricing feeds.
• Engaging in any form of market manipulation or insider trading.
• Using non-public information to gain an unfair advantage.
• Front-running, wash trades, or any practices that violate market regulations. Violation of these prohibited trading practices will lead to the immediate suspension or termination of your account, and Traders.Money reserves the right to take further legal action if necessary.

6.5 Prohibition on Data Scraping and Automated Systems

You agree not to use any automated system, software, bots, or devices to access, extract, or manipulate data from the Site or Services, unless specifically authorized in writing by Traders.Money. This includes scraping, crawling, or using automated tools to gather information from the platform. Any use of such systems without authorization is a violation of these Terms and may result in account termination and potential legal consequences.

6.6 Engaging in Fraudulent or Illegal Activities

You agree not to use the Services for any fraudulent or illegal purposes, including but not limited to:

• Identity theft or misrepresentation of your identity.
• Attempting to defraud Traders.Money, other users, or any third-party partner.
• Engaging in money laundering or any activity that violates financial laws and regulations. Any fraudulent or illegal activity will result in the immediate termination of your account and may be reported to relevant authorities for further investigation and action.

6.7 Violation of Intellectual Property Rights

Users are prohibited from copying, modifying, distributing, displaying, or performing any content or services provided by Traders.Money without explicit written permission. Any attempt to reverse-engineer, decompile, or disassemble the platform’s software or proprietary tools is also strictly forbidden. Any infringement of Traders.Money’s intellectual property rights will be met with legal action, and the offending account may be terminated immediately.

7. Ownership and Intellectual Property

7.1 Intellectual Property Ownership

All content, software, designs, logos, trademarks, trade names, data, and other materials made available on the Traders.Money Site or through the Services (collectively, the “Content”) are the exclusive property of Traders Money LLC or its licensors. This includes but is not limited to:

• Text, graphics, images, videos, and designs.
• Proprietary trading tools, signals, market analysis systems, and evaluation software.
• Any custom-developed applications, scripts, or user interfaces used in connection with the Services.

These materials are protected by intellectual property laws, including copyright, trademark, patent, and trade secret laws. You acknowledge and agree that Traders Money LLC owns and retains all right, title, and interest in and to the Content and Services, and that you do not acquire any ownership or usage rights through your use of the platform, except for the limited rights explicitly granted by these Terms.

7.2 License to Use Content

Subject to your compliance with these Terms, Traders Money LLC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Services for personal, non-commercial purposes. This license is restricted to your personal use of the Content and is contingent upon your adherence to these Terms.

This license does not grant you any rights to:

• Modify, copy, distribute, perform, transmit, or display any part of the Content without express written permission from Traders Money LLC.
• Use the Content for any public or commercial purpose without express written permission.
• Create derivative works from the Content or reverse-engineer any proprietary software or tools provided through the Services.

7.3 Prohibition on Unauthorized Use

You are prohibited from:

• Reproducing, selling, or reselling the Content or any part of the Services, including but not limited to the proprietary trading tools, signals, or analysis services, without prior written consent from Traders Money LLC.
• Using any trademarks, logos, or other proprietary marks without written permission from Traders Money LLC.
• Accessing or using the Services for the purpose of developing competing products or services or reverse-engineering any aspect of Traders.Money’s technology.

7.4 Protection of Intellectual Property Rights

Traders Money LLC reserves the right to take any legal action necessary to protect its intellectual property rights. This includes seeking injunctive relief, damages, and attorney’s fees in case of infringement or unauthorized use of its Content. Any unauthorized use of the Content may also result in the immediate termination of your account and access to the Services.

7.5 User-Generated Content

If you submit any content to Traders.Money (such as feedback, suggestions, or any other form of user-generated content), you grant Traders Money LLC a perpetual, irrevocable, worldwide, royalty-free, and transferable license to use, reproduce, modify, publish, distribute, and display such content in any form or media for any purpose, including for commercial use.

You represent and warrant that you have all necessary rights to grant such a license and that your content does not violate the rights of any third party, including intellectual property, privacy, or other personal or proprietary rights.

8. Evaluation Accounts and Restrictions on Use

8.1 Evaluation Accounts

As part of the services offered by Traders.Money, users may be provided with Evaluation Accounts, which are simulated trading accounts used to assess their trading performance against specific criteria set by Traders.Money. These accounts allow users to demonstrate their trading skills within a controlled environment before they can access real capital.

The use of Evaluation Accounts is subject to the following conditions:

• Users must comply with all trading rules, performance goals, and criteria established by Traders.Money during the evaluation period.
• Evaluation Accounts are for personal, non-commercial use only and are strictly for the purpose of evaluation and skill assessment. No real financial returns are generated from these accounts unless explicitly stated otherwise by Traders.Money.

8.2 Restrictions on Refund Eligibility

Users are entitled to request a refund within 14 days of their subscription purchase, provided that certain conditions are met. However, the right to a refund is voided if a user has claimed or accessed an Evaluation Account during this period.

Specifically:

• Refund Ineligibility Upon Claiming Evaluation Accounts: If you have activated or accessed an Evaluation Account, you are no longer eligible for a refund, even if other benefits, such as signals or analysis tools, have not been utilized.
• Funded Accounts: Claiming a Funded Account, which occurs after successful completion of the evaluation, does not impact refund eligibility, as the refund policy applies solely to the initial use of Evaluation Accounts.

8.3 Non-Commercial Use of Accounts

Evaluation and Funded Accounts provided by Traders.Money are intended solely for personal use and evaluation. Users are prohibited from:

• Using these accounts for commercial purposes or for any activity beyond the scope of evaluation and authorized trading.
• Sharing account access or using the account for any purpose other than personal evaluation as set forth by Traders.Money.

8.4 Consequences of Account Misuse

Misuse of Evaluation or Funded Accounts will result in immediate action, including but not limited to:

• Suspension or termination of your account.
• Forfeiture of any evaluation results or access to future services.
• Potential legal consequences for any fraudulent activity or violation of Traders.Money’s policies.

8.5 Revocation of Access and Termination of Services

Traders.Money reserves the right to revoke access to any Evaluation or Funded Account without prior notice if it suspects misuse or violation of the platform’s rules and Terms. In the case of such violations, Traders.Money may seek legal remedies, including but not limited to damages for any resulting harm.

8.6 Responsibility for Availability in User’s Jurisdiction

It is the sole responsibility of the user to verify that Evaluation Accounts or Funded Accounts are legally available in their country or jurisdiction. Traders.Money does not guarantee that its accounts or services will be available in every region and will not be held liable for any restrictions, legal issues, or unavailability in the user’s country. Users are advised to ensure compliance with local laws before subscribing to or accessing services. Traders.Money will not be responsible for refunds or any losses incurred due to unavailability of accounts in the user’s jurisdiction.

10. Electronic Communications and User Consent

• Marketing communications (if opted-in).
• Subscription and billing information.

Communications will be delivered via email, in-app notifications, live chat, or any other method we determine to be appropriate. By consenting to electronic communications, you acknowledge that such communications satisfy any legal requirement that they be made in writing.

10.2 Opting Out of Marketing Communications

Traders.Money does not guarantee that the use of its services will lead to profitable trading outcomes or success in any financial markets.

11.2 Limitation of Liability

To the fullest extent permitted by applicable law, Traders.Money, its officers, directors, employees, affiliates, agents, contractors, licensors, service providers, and suppliers shall not be liable for any direct, indirect, incidental, punitive, consequential, or special damages arising from:

• Your use or inability to use the Site or Services.
• Errors or inaccuracies in the content provided by Traders.Money.
• Any financial losses, lost profits, lost revenue, or other economic damages resulting from your use of trading signals, tools, or evaluation accounts.

This limitation applies regardless of whether the damages are based on contract, tort (including negligence), strict liability, or any other legal theory, even if Traders.Money has been advised of the possibility of such damages.

11.4 Assumption of Risk

By using the Services, you acknowledge and agree that trading financial instruments, including but not limited to foreign exchange (forex), commodities, and other asset classes, involves significant risk, including the potential for substantial losses. You agree that Traders.Money is not responsible for any losses incurred as a result of your trading activities. You assume all responsibility and risk associated with your use of the Services.

11.5 Third-Party Content and Links

The Site may contain links to third-party websites or services that are not owned or controlled by Traders.Money. These links are provided solely as a convenience to you. Traders.Money makes no representations or warranties regarding the content, privacy policies, or practices of third-party sites and accepts no liability for any damages or losses resulting from your use of such sites.

Traders.Money makes no representations or warranties regarding third-party websites or services, and will not be held liable for any damages or losses caused by:

• Errors or omissions in third-party content.
• The accuracy, completeness, or legality of third-party websites or services.

13. Indemnification

13.1 User’s Agreement to Indemnify

You agree to indemnify, defend, and hold harmless Traders.Money, its parent company, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, employees, and representatives (collectively, “Indemnified Parties”) from and against any and all claims, damages, liabilities, losses, expenses, and costs (including reasonable attorneys’ fees) arising from or related to:

• Any breach by you of these Terms.
• Any violation of applicable laws, regulations, or third-party rights.

Traders.Money reserves the right, at its own cost, to assume the exclusive defense and control of any matter subject to indemnification by you. In such cases, you agree to cooperate fully with Traders.Money in asserting any available defenses. You must not settle any matter without the prior written consent of Traders.Money.

13.4 Limitation of User’s Liability

The indemnification obligations herein shall survive the termination of your account or these Terms. You acknowledge that this indemnification provision is an essential part of these Terms and is necessary to protect Traders.Money’s interests and ensure the ongoing integrity of its platform.

14. Arbitration and Dispute Resolution

14.1 Binding Arbitration

By agreeing to these Terms, you agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Traders.Money platform, or any services provided by Traders.Money shall be resolved exclusively through binding arbitration. Arbitration will replace the right to go to court, and there will be no judge or jury in the arbitration process.

The arbitration will be conducted by a single arbitrator under the rules of the American Arbitration Association (AAA) or any other mutually agreed upon arbitration body. The arbitrator’s decision will be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

14.2 Arbitration Location and Procedure

Unless otherwise agreed by the parties or required by law, the arbitration will take place in the jurisdiction where Traders.Money is registered, or it may be conducted virtually if agreed upon by both parties. The arbitration shall be conducted in English, and the parties shall bear their own legal fees unless the arbitrator awards otherwise.
